Registering an Advance Personal Plan

It is strongly recommended to register an Advance Personal Plan, even though it is not required in the Northern Territory.

Registering the plan with the Public Guardian and Trustee helps make it easier for health care providers and decision makers to find and use the plan, especially in urgent situations involving health or money decisions.

Appointments are not required to register a plan with the Public Guardian and Trustee.

Registering an Advance Personal Plan does not mean the Public Guardian and Trustee has checked, approved or endorsed the contents of the plan, or confirmed that the plan is legally valid or able to be carried out. It is the responsibility of the person making the plan to make sure it meets legal requirements.

Registration with the Public Guardian and Trustee is free and easy:

  1. fill out the application form, DOCX (731.8 KB)
  2. send the original plan by registered or tracked mail or deliver it in person to the Darwin office.

The plan will be stamped with a unique registration number and sent back.

If a registered Advance Personal Plan is later updated, the new copy should be registered, and the old one destroyed. This will prevent any confusion for health care providers and decision makers.

Decisions about real estate cannot be made if the Advance Personal Plan is not registered with the Land Titles Office. There is a fee associated with registering plans with the Land Titles Office.

Registration requirements vary from state to state. Where there is a decision about property interstate, contact the relevant Land Titles office. They can assist with the appropriate registration requirements.

Revoking or changing an Advance Personal Plan

An Advanced Personal Plan can only be revoked by the person who made the plan while they have decision-making capacity.

How to revoke an Advance Personal Plan:

  • destroy the original and any known copies
  • notify in writing anyone with a copy of the revocation such as:
    • health care providers, family, legal representatives, decision makers
  • notify in writing any register holding the Advance Personal Plan such as:

Any new Advanced Personal Plan must be signed and witnessed correctly. It should be registered and provided to relevant decision makers, health professionals.
